If SHGM is handling your immigration matter, additional information may be requested from you. These additional items may include items such as your personal and family information, educational background, employment history, travel history, and financial records. As required by relevant governmental authorities, additional sensitive information may also be requested from you including corporate information, health-related information and information about your personal character history.

How SHGM collects information

We collect personal information by various means including, but not limited to, when:

  • you contact us (in person, my phone, email or through our website) with a question, inquiry and/or to request information.

  • you subscribe to our newsletter or update services.

  • you attend a seminar or event where we are hosting or presenting.

  • you instruct us to act for you, and we open a file for your case.

  • you complete a questionnaire providing the information required for your visa application or immigration matter.

  • you provide us with your business card at a meeting or event; and/or

  • from publicly available sources.

Where practicable we collect personal information about you directly from you.

However, we may collect information about you from a third party such as your employer, a client, the Department of Home Affairs, tribunals, courts or a person responding to our questions or inquiries.

How SHGM uses the information we collect

We collect, hold, process, use and disclose personal and as applicable, corporate information to:

  • respond to your enquiries.

  • provide migration services.

  • comply with any applicable law.

  • monitor or improve the use of, and satisfaction with, our services.

  • enforce our agreements with you; and

  • let you know about immigration developments, our expertise and services and information that may be of interest to you.

SHGM may also use the information we collect to communicate with you directly via telephone, e-mail or direct mail, to inform you about newsworthy topics and upcoming events that may be of interest to you, or to advise you about your visa or other immigration matter. We may also use your email address to send you reminders of expiring visas or other immigration statuses.

How SHGM protects the information we collect

Protecting the information, we receive from you is of the highest priority for SHGM. 

While no system can guarantee complete security, we take appropriate measures to protect the information you provide us. Information transmitted to us via our website - or by other electronic means - is encrypted using industry-standard mechanisms, including SSL and TLS, which is updated regularly to ensure the secure transmission of all personal and corporate data.

SHGM also secures your personal information on our systems in accordance with the Migration (Migration Agents Code of Conduct) Regulations 2021. All personal information and data is secured within Microsoft’s Azure cloud (https://azure.microsoft.com/en-au/explore/trusted-cloud/) and resides in Australia.

All personal information and documents provided to the Department of Home Affairs is secured in accordance with the Department’s privacy policy (www.homeaffairs.gov.au/access-and-accountability/our-commitments/plans-and-charters/privacy-policy.

We are committed to continually reviewing and improving our security practices to minimise risk and protect the information entrusted to us.

We will not, under any circumstances, sell your personal information to any third parties. SHGM will not share the information with any third party, except as otherwise set forth in this Privacy Policy.

Deleting your data

In accordance with Australian government regulations, we delete personal data seven years after our services conclude.

We may, however, retain and use your information for a longer period if this is necessary for us to comply with our legal obligations, government auditing requirements, resolve disputes, and enforce our agreements. At the end of such period, we may, at our discretion, destroy your data without notice to you.

How to opt-out of further communication

We provide users the opportunity to opt-out of receiving further communications from us at their request. To opt-out of further communications contact us by email at visas@stirlinghenry.com.

SHGM’s website may, from time to time include social media features, such as links to Instagram and LinkedIn. These features may collect your IP address, which page you are visiting on the website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the website. Your interactions with these features are governed by the privacy policy of the company providing it.

The right to have your personal information deleted.

At any time, you have the right to request that SHGM deletes the personal information you have provided to us. SHGM will delete any data if it is legally allowed to do so in accordance with the laws and regulations in the countries in which we operate.

You may make this request in writing via email to visas@stirlinghenry.com.

Once your request has been received the following actions will take place:

  • SHGM will acknowledge your request.

  • SHGM will review your specific request and determine if we are lawfully allowed to oblige the request.

SHGM will then either:

  • Inform you that your data has been removed from our systems or

  • Inform you as to the date that SHGM is legally allowed to remove the data from our systems given the nature of the data and the applicable legislation.

The SHGM website may, from time to time, contain links to other websites.

SHGM is not responsible for the privacy practices or the content of such websites. We encourage you to read the privacy policies of these websites before transmitting any personal identifiable information to third parties.
